Police Pension Board Expecting Administrative Review

IL-GalesburgPDAttorneys representing David Hendricks have requested an administrative review of a decision made by the Galesburg Police Pension Board.

Hendricks pleaded guilty in 2008 to charges of Official Misconduct and Possession of a Controlled Substance.

The Pension Board denied a request for Hendricks to receive his pension in December of last year.

Now, the matter will be settled in court after the pension board received a summons requesting the review.

Written opinions and meetings were held with the Pension Board’s outside attorney prior to making their decision to deny Hendricks his pension last month.

Pension Trustee Elisa Tanner says an initial review of the request is expected.

“Bases on my review of the law independently of our attorney and discussions with other attorneys it was a void sentence and what we did is appropriate so I would expect that to be the ultimate finding. I think everybody else the board would too based on our attorney’s reasoning.”

Hendricks was sentenced to jail time and an alternative treatment program after allegedly stealing drugs from an evidence locker in 2007. That sentence was later vacated.

The Board has time to respond to the summons before the review appears in court.
