Proposed Changes to Victim Impact Statements
Victims could have more of a say in what happens after a defendant is found "not guilty by reason of insanity."

An Illinois House committee has sent to the floor a bill which would allow a "victim impact statement" as the state considers where such a patient will live. The committee heard from Barbara McNally, a woman from Bartlett whose husband was killed in 2006 by a childhood friend, James Masino.

McNally says over her objection, Masino was placed in a mental health facility in Elgin, which, she says, would put him within a train ride of her neighborhood if he were to escape. She cites a 2009 escape from that facility in which the patient was wearing street clothes, and not even noticed missing for hours.

H.B. 4807 has passed the House Judicial II (Criminal Law) Committee.
