Charges Stand for Convicted Abuser
A Galesburg man isn't getting a break from a judge after he was convicted of beating his then-girlfriend last January.

Knox County Circuit Court Judge Scott Shipplett Wednesday denied a motion filed by the defense attorney asking the judge to reconsider dismissing the charges in the case of 47 year old Sterling Nicholson.

Nicholson was convicted in October of Aggravated Battery and Aggravated Domestic Battery, but a jury found Nicholson not guilty of attempted murder.

Public Defender Jim Harrell argued for the dismissal citing a motion filed early on in the case that he says was inaccurate and frivolous, and that led to the violation of Nicholson's right to a speedy trial.

But Shipplett says if you calculate all motions filed and attributable to the defense, the trial was held well within a 120 day window under the law, even though the attack happened in January, and the trial happened in October.

Nicholson was convicted of beating a 41 year old woman at her home, leaving bleeding on the brain and other serious injuries.

He'll he sentenced next month.
