Illinois Municipal League Doesn't Support More Government Transparency
Changes to the state's Freedom of Information Act went into effect Jan. 1. The purpose was to make public information and documents more easily available with a speedier response.

Members of the Illinois Municipal League, however, still oppose the legislation for a number of reasons. Brian Day, staff attorney for the group, says the law creates confusion for local governments because of some laws that require information to be withheld, while FOIA makes information more accessible, and many municipalities will have trouble reconciling the conflict.

Among other things, the law requires governments to respond to FOIA requests within five business days instead of seven, and establishes a presumption of transparency for public records, which would require government bodies to prove--with evidence--why information should be withheld. Finally, the law requires public bodies to appoint employees to complete annual training in FOIA matters.
