| Prosecution Rests in Galesburg Murder Trial |
POSTED 11:49am, UPDATED 2:39pm 3/24/09 The team prosecuting a Galesburg man in the murder of another area man last August outside of a bar has rested their side of the case. The court heard the final questions asked of the doctor who performed an autopsy on 29-year old Deriek Lawless. Lawless was allegedly shot and killed by 32-year old Marlon Brown in the parking lot of Andrews Lounge last year.
Dr. Violet Hnilica finalized her testimony by giving an exact cause of death., which was gunshot wounds to the head and trunk of the victim. Hnilica said that the bullet that passed into Lawless' head and through the mid-brain which resulted in a rapidly fatal injury. She says the victim had drugs in his system including methamphetamine, ecstasy, and marijuana, but that they had no bearing on the cause of death.
The defense began their case by playing a police interview with prosecution witness Howard Moss, who lived near Andrews Lounge, then played recordings of at least 9 phone calls to 911 the morning of the shooting. At least one of the callers allegedly identified Brown as a shooter saying, "It was a guy named Marlon, he left in a white car."
The defense also heard from a witness who took the stand countering a prosecution witness who claimed a man who testified to witnessing the shooting may have been inside playing pool at the time of the shooting.
Brown faces felony charges including First Degree Murder when the trial comes back into session Wednesday morning. |
