Re-sentencing for Accused Attempted Murderer Delayed
A Galesburg man found guilty for the second time of attempted murder and other felony charges following a 2004 incident will not be re-sentenced just yet.

41-year old Jerry Mabry was in Knox County Circuit Court Tuesday, where he was to be sentenced after being convicted last October on charges of Attempted First-Degree Murder, Aggravated Criminal Sexual Assault, Aggravated Battery, and Unlawful Restraint.

But Knox County State's Attorney John Pepmeyer told Judge James Stewart that he hadn't read through all one-thousand-plus pages of transcripts from the trial yet.

Mabry's attorney, Knox County Public Defender Jim Harrell, is also expected to file a motion related to whether or not a sex offender evaluation needs to be conducted on Mabry. Harrell claims it isn't needed, and an evaluation that was believed to be ordered after Mabry's first trial in 2004 isn't in court documents, so it's not known whether or not it was actually done.

Mabry was convicted of the same charges then, but the verdict was later thrown out due to suspected juror misconduct.

Mabry, who insisted on representing himself during both trials, is now being represented by Harrell for the purpose of post-trial motions.

A hearing on the sex offender evaluation will be held March 31st, and then a new sentencing date could be set.

Mabry allegedly beat and repeatedly raped a now-former Galesburg resident inside her then-Mulberry Street residence in June of 2004.
