Videotaped Confession to Be Allowed in Felony Sex Case
A Galesbug teenager described in court as mentally ill apparently knew what he was doing when he confessed during a videotaped interrogation to performing a sexual act in front a minor, so a judge says a jury can see that confession.

Judge Paul Mangieri made that ruling Thursday in the case of 17 year old Kory Agans, charged with Sexual Exploitation of a Child.

Agans was arrested last July, and his attorney, Public Defender Karl Johnson, had sought to have that confession suppressed.

Agans testified yesterday he was just telling police detective Bob Schwartz what he wanted to hear, so the 23 minute interview would end.

In that interview, which was played in court, Agans first denied then later confessed to the incident, but Mangieri noted that Agans pointed out the teen would go to jail if he confessed.

Mangieri says it was that acknowledgement that determined to him that Agans knew exactly what he was doing, despite an exam that determined he has the I.Q. of a 10 year old, the same report that says he's fit to stand trial.

A Pre-trial hearing in the case has now been set for May 12th. Agans is currently not being held in jail.
