Mabry Found Fit to Stand Trial

A former Galesburg man who's been granted a re-trial on charges of Attempted Murder, Sexual Assault, and Battery has also been found mentally fit to stand trial.


Knox County Circuit Court Judge James Stewart made that ruling Wednesday in the case of 41-year old Jerry Mabry.


Mabry was found guilty in late-2004 of allegedly beating and sexually assaulting a then-40-year old Galesburg woman inside a Mulberry Street home, but has since been granted a new trial.


A psychological exam conducted on Mabry indicates he is able to understand all court proceedings, and that he can assist in his defense at the new trial.


Stewart also said he would take under advisement a motion filed that would seek to limit testimony in the new trial, specifically, any that may relate to the sexual assault and aggravated domestic battery charges Mabry was acquitted of four years ago.


Stewart did grant a motion for additional evidence in the case.  Mabry claims he didn't receive all of the documentation he had gathered in his own defense when he was transferred to prison from the Knox County Jail, and Stewart has given the Knox County State's Attorney until May 30th to produce photographs of injuries Mabry sustained, hospital records, reports from the Morton Crime Lab, and some memos sent between former State's Attorney Paul Mangieri and former Jail Administrator Richard Morris regarding electronic recordings that might have been made at the jail.


Trial in the case is scheduled to begin next month.


Mabry was sentenced to 22 years in prison after originally being found guilty.
