Judge to Consider Constitutionality of Illinois Death Penalty at Sheley Court Hearing
A judge is expected to consider several motions challenging the state's death penalty in the case of a man charged with killing eight people last year, including a Galesburg resident.

Knox County Circuit Court Judge James Stewart Friday morning is scheduled to consider motions from public defender Jim Harrell and co-council Jeremy Karlin challenging the constitutionality of Illinois' death penalty law. Prosecutors are seeking the death penalty for 29-year-old Nicholas Sheley for the murder of 65-year old Ronald Randall of Galesburg last June. Sheley is charged in that death, five others in Whiteside County and two more in Missouri. The local case is being tried first.

No trial date has been set. The hearing is scheduled for 9:30 a-m Friday.

Sheley also is charged with aggravated battery, criminal damage to property and assault for allegedly throwing metal chair legs at corrections officers at the Knox County Jail and striking another officer last month.

The Sterling man is being held on $10-million bond in the murder case and $500,000 for the incident at the jail.
