Blago Case Going to Supreme Court
The case of ex-Gov. Rod Blagojevich is going to the Supreme Court.

Blagojevich lawyer Sam Adam said Monday that he'll file with the Supreme Court on Tuesday. He's not expecting to go before the justices for a hearing, but he wants the Supreme Court to order a delay in the Blagojevich corruption trial, which is scheduled to start June 3.

At issue is the concept of "honest services," the right of the public not to be deprived of "honest services" by its government officials, and officials who do so are guilty of the crime of "theft of honest services."

The Supreme Court is expected to rule on a constitutional challenge to the honest services concept sometime in June, and Adam wants a delay until that ruling comes down, because several of the counts against Blagojevich charge him with honest-services fraud.

The prosecution wants to proceed without that ruling, and trial judge and the appeals court have already said no to a request for delay.
