Durbin Discusses Supreme Court Nominee
There's no schedule yet for a confirmation hearing for Supreme Court nominee Elena Kagan, but when it happens, it will not be the first time for her.

U.S. Sen. Dick Durbin (D-Ill.), who sits on the Judiciary Committee, which will hold the confirmation hearing, notes that Kagan has been in the committee's witness chair before, as the nominee for he current position, solicitor general, in which she argues the administration's position if the government is involved in litigation before the Supreme Court.

"She's not a new nominee in that respect. We know who she is. We know her qualifications," Durbin said.

Kagan was also nominated by President Clinton in 1999 to a position on the federal circuit court for the District of Columbia. The Senate, in Republican hands at the time, never held a confirmation hearing for her, and her appointment expired with the Clinton presidency.

Durbin is a supporter of Kagan, but he says he's not bound to vote for her; he could change his mind if important evidence arises from the confirmation hearing.
