Probable Cause Found in 2006 Felony Sex Case
A Galesburg man can now stand trial on charges accusing him of sexually assaulting a then 16 year old girl in 2006.

Knox County Circuit Court Judge Scott Shiplett Tuesday found probable cause for 24 year old Richard Garza to be tried on felony charges of Criminal Sexual Assault.

During a preliminary hearing, Galesburg Police Officer Jason Paulsgrove testified that he discovered a 16 year old girl allegedly intoxicated in the 800 block of South Chambers Street.

The girl, who Paulsgrove said wasn't coherent at the time, but was believed to have been given marijuana, cocaine, and alcohol while at a home there.

He says the girl's mother claimed the girl did have sexual contact with two men at the home, and DNA evidence taken later apparently came from two separate people.

Paulsgrove says the DNA samples turned up negative in 2006, but officers were notified in March that one of the samples later matched Garza.

In addition to the probable cause finding, a judge refused to lower Garza's 75-thousand dollar bail, citing the seriousness of the crime.

Garza will be back in court for a pre-trial hearing July fifth, and for now, remains jailed.
