Abingdon Train Fatality Ruled Accident

A Knox County coroner's jury is ruling the death of a teen struck by a train last month in Abingdon an accident.

13-year old Shawn Garzee-Stone died May 26th around 9:25 p-m south of the East Sanitary Road railroad crossing in Abingdon. Detective Tim Sandrock with the Knox County Sheriff's department told the jury Tuesday night during an inquest that Garzee-Stone and his cousin were towing a go-kart with a bicycle and a rope when the rope came undone and the go-kart got stuck on the train tracks as an Amtrak train was approaching.

Sandrock testified Garzee-Stone went back to try and dislodge the go-kart when he was struck by the train, which was traveling 79 miles an hour. The investigator says the train was blowing its horn, and the crossing arms and lights were working at the railroad crossing. Testimony also indicated Garzee-Stone had just bought the go-kart, which wasn't running, and was taking it home. Sandrock says the investigation ruled out both suicide or someone pushing Garzee-Stone onto the railroad tracks as the train was approaching.

The jury ruled Garzee-Stone died from blunt force injuries from being struck by the train, and that his death was an accident.

The jury also ruled the death of 36-year old Robert Jennings of Knoxville as undetermined. He was found by a passerby during the early morning hours of June 20th, 2007, along Steakhouse Road after he left a tavern near Knoxville earlier that morning. An autopsy revealed the cause of death was blunt force injury to his head with terminal asphyxia by unknown causes. Testimony during the inquest indicated Jennings had been in a car accident about six weeks before his death and was injured, but the crash was not reported to the police and he did not go to the hospital or a doctor.

The autopsy was unable to directly link the accident to Jennings' death.
