Trial Delayed for Galesburg Man Accused of Attempted Murder
A jury trial scheduled in the case of a 30-year-old Galesburg man accused of attempted murder last November has been cancelled.

Knox County Circuit Court records indicate Cody Thomas's trial was supposed to begin Monday. Thursday, Judge Paul Mangieri granted the prosecution a continuance to prepare for a "last minute" move by the defendant's attorney.

Assistant States' Attorney Elisa Tanner says Joseph Borsberry indicated just this week he would be asserting 'self defense' as his client's defense. Tanner says she needs more time to research the Peoria lawyer's latest strategy.

Thomas is accused of striking a 34-year-old woman over the head with a brick the morning after Thanksgiving. The victim reportedly suffered critical injuries to her head and face. Prosecutors allege Thomas also committed non-consensual sexual acts to the woman in the five-hundred block of Liberty Street.

Thomas has been charged with three-counts of Attempted First-degree Murder, two-counts of Aggravated Criminal Sexual Assault, and one-count of Aggravated Battery.

He remains jailed on $500,000-dollars bond. A Pre-Trial Conference is set for July second.

Tanner says a motion to permit new evidence at trial was denied Thursday as well.
