Request Denied to Dismiss Charges in Riley Case
POSTED 2:57pm, UPDATED 3:12pm 7/20/10 A former Galesburg police officer will face official misconduct charges at his trail next month.

Warren "Tony" Riley was arrested in March on allegations he stole money, used for controlled drug buys, from the police department.

Riley was in court Tuesday with his attorney John Rehn for a motion to dismiss three charges of official misconduct.

Rehn argued the state statute concerning official misconduct is much too broad and vague.

The law state's it is felony offense for an employee to knowingly preform an act which the person knew was prohibited.

Rehn says the law is not specific and gives too much discretion to prosecutors. He says, for instance, the law is so vague a police officer could be charged with a felony offense if they speed in their vehicles or roll through a stop sign.

Special prosecutor Chuck Zalar, who was appointed to the case, argued, however, former court cases have construed the law in such way it is fair.

Zalar added that no argument was presented suggesting Riley did not know his alleged actions were prohibited, but Zalar said, being a police officer he thought it would be obvious theft is illegal.

Judge James Stewart agreed with Zalar and denied the motion to dismiss the official misconduct charges.

Riley also faces a felony theft charge. His jury trial is tentatively scheduled for August 16th.
