A Quick Turn-Around for Blago Trial Re-Run
A Galesburg attorney says he believes federal prosecutors in the Rod Blagojevich corruption trial, in that they're going to try Blagojevich again sooner rather than later.

Jeremy Karlin of the firm Alcorn-Karlin says he was surprised somewhat that the jury was only able to come to consensus on 23 of 24 counts the ex-Governor faced, but believes U.S. Attorney Patrick Fitzgerald when he says he will try the case again sooner rather than later.

Karlin tells WGIL a timeframe of 60 to 90 days for a new trial definitely isn't out of the question, even if some decompression time is needed.

"I think everyone's going to want to take a little bit of a break," Karlin said. "To the extent that they have to notify the defense of any additional witnesses that weren't on their witness list to begin with, they may have to...be some motions that have to be heard -- some motions in linime, like a pre-trial or a preliminary evidentiary issues will need to be addressed."

As for the defense strategy of essentially not presenting a defense, Karlin says sometimes, that's simply the way to go. Nonetheless, he calls it a "tactical move" and sometimes risky, but the burden of proof always lies on the prosecution to prove that the accused is guilty, moreso than the defense having to prove innocence.
