Videotaped Deposition Allowed in Sheley Case
A videotaped confession that didn't adhere to normal standards will be allowed to be used in the local trial of accused spree killer Nicholas Sheley.

Knox County Circuit Court Judge James Stewart made the ruling Friday. At issue was a videotaped deposition by Pamela Sabben not long after Sheley allegedly killed 65-year old Ronald Randall.

Sabben passed away not long after the deposition, and didn't sign any documents validating her deposition -- causing concern that prejudice would be shown.

Stewart ruled that Sabben's testimony was clear, and that it should be used.

Sabben testified that she waited on Sheley when he entered the Hy-Vee gas station June 28 of 2008, and saw blood on his face and hands.

She says she became scared two days later when watching a T-V report on Sheley's alleged acts and determined that the man she sold beer and cigarettes to was him.

Stewart also denied a request agreed to by both sides to sequester the jury.

But he allowed statements to be used at trial which Sheley made when he was arrested -- things like that he admitted to doing bad things and hoped that God would forgive him.

The trial is still scheduled to begin with jury selection August 29th.
