Sheley Called to Testify in Brother's Whiteside County Trial; Judge to Consider
POSTED 12:36am 9/22/09 One of the attorneys for accused spree killer Nicholas Sheley has intervened in the criminal trial that was to have started this week against Sheley's brother.

The Sterling Daily Gazette reports Jeremy Karlin last week filed a motion to intervene, and to quash a motion filed in Whiteside County Court in Morrison, having Sheley testify in the trial of 31-year old Joshua Sheley.

The Gazette reports Joshua Sheley faces charges of Concealing a Homicidal Death and Obstruction of Justice, related to the death of 93-year old Russell Reed of Sterling, one of eight deaths Nicholas Sheley is accused of committing, which includes 65-year old Ronald Randall of Galesburg.

Nicholas Sheley was expected to testify at his brother's bench trial, but the Gazette says Whiteside County Judge John Hauptman ordered an October 22nd hearing following a review of both psychological exams conducted in the Knox County case.

Karlin claims Nicholas Sheley can't knowingly waive his right to remain silent.

Instead of a trial scheduled for Wednesday Hauptman will hear defense motions to quash Joshua Sheley's arrest and dismiss the case.
