New Motion for New Trial in Sheley Case Denied
Another game of "Blame the Media" is going on in the case of accused spree killer Nicholas Sheley.

Defense attorney Jeremy Karlin filed, and was denied, a motion for a mistrial and another change of venue in the case,now that a full jury of 12 jurors and six alternates has been seated.

Karlin again cited pre-trial publicity, and he specifically cited at one point the August 28th Galesburg Register-Mail. The paper that day had an extensive trial preview, pictures of Sheley in shackles, and pictures of the eight victims in two states Sheley is accused of killing, including 65-year old Ronald Randall of Galesburg.

Assistant Illinois Attorney General Mike Atterberry argued that the jurors said they could put aside their opinions about the case, and be impartial, and Judge James Stewart agreed. He said a "solid" jury has been picked, and that Karlin's change of venue request is almost too late now, but could be taken up by an appellate court later.

The full jury was sent home for the day, and asked to be back before 9am Friday. That's when opening statements and testimony are expected to begin.
