Lawmaker Says Cook County Eviction Stoppages Good Idea, And the Law in Illinois
Cook County Sheriff Tom Dart is getting all sorts of attention -- not all of it good -- for deciding to stop sending his deputies on court-ordered mortgage foreclosure evictions if the people losing their homes are renters.

Dart is being sued by a mortgage lender, which demands that Dart restart the evictions.

But State Rep. Al Riley (D-Olympia Fields) says Dart can't evict, at least not yet. He cites a law that went into effect in January that guarantees some time so that renters can find a new place. Riley sponsored the measure and said, "Senator [Maggie] Crotty and I had a situation that occurred in our area, matter of fact it was in Country Club Hills, Illinois, where this exact thing happened. There were tenants being evicted because the landlord's property was in foreclosure. We thought there ought to do something. After all, if you're renting, you don't have a thing to do with the financial situation of your landlord."

The tenants must be current on their rent. The law is in effect for every part of the state.
