Attempted Murder Re-Trial Starts Tuesday
Jury selection has completed, and the re-trial of a Galesburg man facing attempted murder charges can begin -- but not before a last-minute admission by the defendant.

41-year old Jerry Mabry faces charges of Attempted First-Degree Murder, Aggravated Battery, Unlawful Restraint, and Aggravated Criminal Sexual Assault for the alleged beating and raping of a then-Galesburg woman inside her Mulberry Street home in June of 2004.

Before Monday's jury selection was about to break for lunch, Mabry -- again representing himself -- disclosed that he intends to claim his actions were self-defense. Knox County State's Attorney John Pepmeyer objected, claiming that should have been included in information provided during the pre-trial discovery phase. Judge James Stewart agreed, but also said while a violation of discovery, the defendant should essentially be able to represent himself as he sees fit.

The State, Stewart says, will now be allowed to call additional witnesses, and will be able to ask more questions of already-scheduled witnesses.

The all-white jury has mostly women, and will start Tuesday at 9am at the Knox County Courthouse. The trial is expected to take all week. Mabry's re-trial was granted following allegations of juror misconduct during the first trial.
