Accused Attempted Murderer Wanted Doctor on Jury Who Has Treated Victim
If a Galesburg man being tried for a second time on charges of Attempted Murder had his way, there might have been a man on the jury that had a clear conflict of interest.

Jury selection in the re-trial of 41-year old Jerry Mabry did complete Monday, but not before some disagreement on one of the potential jurors. One of the potential jurors was a man whom we won't identify, who disclosed that he's a therapist with Bridgeway, and is believed to have had as a client the now-former Galesburg woman Mabry is accused of raping and beating repeatedly inside her Galesburg home in June of 2004.

The therapist said on multiple occasions during questioning there was no way he could be fair or impartial. Both Judge James Stewart and State's Attorney John Pepmeyer wanted the potential juror dismissed immediately, but Mabry -- representing himself -- said, "I want him on."

The man was later dismissed anyway, as was a man who's the son of former Knox County Jail Administrator Richard Morris, listed as a potential witness in the case.

Nine women are on the jury, another three are men, and both alternates are also men.

The trial on charges of Attempted First-Degree Murder, Aggravated Battery, Unlawful Restraint, and Aggravated Criminal Sexual Assault will begin at 9am Tuesday at the Knox County Courthouse and will last the rest of the week.

It was granted following accusations of juror misconduct in the first trial.
