"An Attempted Murderer Sitting in This Courtroom"
The attempted murder re-trial of a Galesburg man has begun, but perhaps not in the way the defendant wanted it.

Opening statements were held Tuesday in the case of 41-year old Jerry Mabry, facing charges of Attempted First-Degree Murder, Aggravated Battery, Unlawful Restraint, and Aggravated Criminal Sexual Assault.

Knox County State's Attorney John Pepmeyer told the nine-woman, three-man jury that they'll be hearing from the State the story of, "an attempted murderer who's sitting in this court today."

Pepmeyer says jurors will also hear the victim say to police on the morning of June 14th, 2004, "Jerry Mabry did this to me." He says they'll also hear Mabry essentially confess while held in the Knox County Jail.

Mabry, representing himself, questioned the involvement of several Galesburg Police Department officers, who will testify, and that investigators never actually asked him what happened. Mabry also said that the victim is the one that initiated the attack, following several allegedly unsuccessful attempts in prior weeks at starting a relationship.

Mabry was admonished at one point by Judge James Stewart, alleging Mabry stopped using his opening statements to tell jurors what would be presented in the case, and instead started arguing the case.

The victim's daughter and three Galesburg Police officers have already testified in the case, with more starting at 9am Wednesday.
