Mabry Guilty of Attempted Murder, Other Felonies
POSTED: 3:55pm 10/27/08 A Knox County Jury apparently didn't believe that a Galesburg man was acting in self-defense when a woman turned up beaten and allegedly sexually assaulted inside her Mulberry Street home June 14, 2004.

The nine-woman, three-man jury took around four-and-a-half hours Monday to find 41-year old Jerry Mabry guilty of Attempted First-Degree Murder, Aggravated Criminal Sexual Assault, Aggravated Battery, and Unlawful Restraint, during a re-trial granted following alleged juror misconduct four-years ago.

Knox County State's Attorney John Pepmeyer tells WGIL he couldn't be more happy with the verdict, given how strong the evidence was. "We believe the photographs (of the crime scene and of the victim following the assault), the exhibits, the testimony in particular of our victim, the corroboration offered by all police witnesses -- that's what made the case," Pepmeyer said.

Pepmeyer admits it was a somewhat difficult case to try because Mabry was representing himself. During closing arguments, Mabry claimed that the victim wasn't telling the real story, and that only he and the victim really know what went on that night, with Mabry claiming she attacked him first.

A pre-sentence investigation has been ordered, with a sentencing hearing scheduled for December 17th. Mabry was sentenced to 22-years in prison during the first trial; Pepmeyer says he expects to ask for something similar this time, and Mabry is likely to appeal.
