Judge: Sheley Can Testify in Brother's Whiteside County Trial
The Sterling man accused of killing eight people in two states, including one man in Knox County, will be allowed to testify in the trial of his brother, who's accused of trying cover up one of those deaths.

The Sterling Daily Gazette reports a judge Thursday ruled that 30-year old Nicholas Sheley will tesfify on day three of 31-year old Joshua Sheley's trial for Concealment of a Homicidal Death. That testimony is scheduled for November fifth.

One of Nicholas Sheley's attorneys in the Knox County case, Jeremy Karlin, objected and sought to intervene in the Whiteside County case, claiming anything Sheley says could be used in that case.

Karlin cited a report by defense-employed neuropsychologist Doctor Robert Hanlon, who had originally said Sheley was not competent enough to be able to fire his attorneys and represent himself in the Galesburg case. But Thursday, the Gazette reports Hanlon said he couldn't say with 100-percent certainty that Sheley wasn't competent enough to testify on his own behalf.

Joshua Sheley is accused of trying to hide the death of 93-year old Russell Reed of Sterling. Nicholas Sheley is accused of killing Reed, 65-year old Ronald Randall, and six others either in Whiteside County or in rural Missouri.

Nicholas Sheley had indicated he wanted to plead guilty in the Galesburg case, and Karlin told the Gazette he expects to file paperwork within the next week as required to indicate he had a talk about that plea with Sheley.

It's expected to be taken up during a change of venue hearing November 6th.
