Galesburg Man Convicted on Some Charges, Acquitted of Attempted Murder
A Galesburg man will be sentenced in January after a jury took over eight hours yesterday to find him not guilty of attempted murder, but guilty of two other charges.

The eight woman, four man jury ended up convicting 47 year old Sterling Nicholson of charges of Aggravated Battery and Aggravated Domestic Battery, but acquitted on the attempted murder charge for a late-January assault that left a 41 year old woman with serious injuries including bleeding on her brain.

Knox County Assistant States Attorney Elisa Tanner tells WGIL she's happy with the outcome.

"He's finally going to pay for what he did to her to the tune of the ag [aggravated] domestic battery and the aggravated battery. The sentencing range for those crimes has a 24 year maximum if it's a consecutive sentence."

Public Defender Jim Harrell tells WGIL the outcome wasn't the best, but the jury was a good one.

"I think the jury did a good job at listening to the evidence going through this case piece meal obviously, but the fact that they were out for eight hours you know tells me they sat back and seriously considered this case"

Nicholson maintains it was a passenger in the car he and the victim were in that committed the assault, not him.

Harrell says he'll take some time to talk with his client before determining if there will be an appeal.

Sentencing has been scheduled for January 17th.
