Kirk Not on Hand for Lame Duck Senate Session
(IRN) -- The U.S. Senate re-convened Monday evening, without Sen.-elect Mark Kirk (R-Ill.).

Kirk not only won a full term in the Senate on Election Day, he also won a special election allowing him to take office right away. But "right away" isn’t until the election results are officially declared by the Illinois Board of Elections on Nov. 23, says Sen. Dick Durbin (D-Ill.).

"They [the Board of Elections] argue that it takes that long in some races to get all of the absentee ballots counted, all of the provisional ballots gone through and reviewed, and the military ballots that are coming in. All of this needs to be done so they receive the paper work in a complete form," Durbin says.

Kirk hasn't taken a public position on the issue since he hasn’t spoken to the press since Election Day, though he will be part of a media availability in Washington on Tuesday. Until Kirk is seated, appointed Sen. Roland Burris (D-Ill.) remains on the job.
