Lawmaker Says Governor May be Corrupt, But He's Not "Incapacitated"
One of the General Assembly's chief critics of Gov. Rod Blagojevich says the attorney general's attempt to remove him is off base. State Rep. Jack Franks (D-Woodstock) says the Supreme Court's power to rule the governor is "incapacitated" is intended for injuries from, say, a stroke or a gunshot wound.

Franks has filed a bill which would stop a governor who has been arrested or indicted from appointing a U.S. senator. The process of holding a special election would be covered in a separate bill. Franks says it's possible both bills could be discussed Monday.

At least informal discussions of an impeachment attempt are also expected. Franks says the General Assembly, not the Supreme Court, should be the ultimate authority over whether Blagojevich stays in office -- barring resignation.

Franks has filed HB 6730.
