IL Supreme Court Refuses to Take Up Fitness Claim Against Blago
One option of neutralizing Gov Rod Blagojevich is off the table. The Illinois Supreme Court Wednesday rejected a pair of petitions seeking to at least temporarily take away his powers.

From Attorney General Lisa Madigan: "I am disappointed in the Illinois Supreme Court's decision. Because of Gov. Blagojevich's refusal to resign, the State of Illinois is in an unsustainable situation. The serious criminal charges against Gov. Blagojevich strike directly at the heart of his decision-making process and seriously impede his ability to legitimately exercise the powers of his office. Thus, while the U.S. attorney's office and the impeachment process move forward, the state is left with a governor who cannot make effective decisions on critical and time-sensitive issues."

Madigan filed a similar but separate petition as that of a group of four citizens. One of those plaintiffs, John Bembenek, says he is disappointed but not surprised: "We ventured into unknown territory. We think that the Constitution really was dealing with an inability to govern, not necessarily a physical or mental incapacity."

Bembenek, of the Champaign area, is co-founder of the Illinois Citizens Coalition.
