Evidence in Rockford Slaying of 4 Survives Legal Challenge

ROCKFORD, Ill. (AP) –Evidence in the case against a Rockford man charged with killing four people, including two children, has survived a legal challenge from defense attorneys who alleged it was seized illegally.

The Rockford Register Star reports Winnebago County Judge John Truitt ruled on Thursday that Rockford police detectives didn’t violate laws when they entered a home where suspect Calvin L. Carter III had lived.

The judge says they could check if Carter was there before getting a search warrant.

Carter is charged in the December 2014 slayings of 24-year-old Martia Flint; her boyfriend, 24-year-old Demontae Rhodes; and Flint’s two sons, 6-year-old Tyrone Smith III and 4-year-old Tobias K. Smith. They were found dead in a Rockford apartment. Carter also faces

home invasion among other crimes.
He has pleaded not guilty.
