CHICAGO (AP) – A suburban Chicago man won’t face criminal charges for shooting another man but he’s headed back to prison for violating his probation. The office of Cook County State’s Attorney Kim Foxx decided 31-year-old Kevin Delaney of Melrose Park acted in self-defense when he shot another man last September 29 in the western suburb. The Chicago Sun-Times reports prosecutors said Delaney and the wounded man were “mutual combatants” and didn’t charge either. But federal prosecutors said Delaney, who was on probation for a federal gun conviction, violated the terms of his release by having a gun. Delaney faces eight months to two years in prison when he’s sentenced for the probation violation.
