A Granite City man charged with two counts of murder for the April 29, 2022, death of a Knox County deputy at Alpha faces a two-week jury trial in Henry County Circuit Court starting Oct. 23.

Deputy Nicholas Weist was struck by a vehicle driven by Daylon K. Richardson, 24, as the deputy put out stop sticks on Rt. 150 at Alpha to stop Richardson’s vehicle. Richardson was fleeing from other Knox County deputies after being seen with a gun at a Galesburg gas station.

During a status hearing on Friday, Judge Norma Kauzlarich said she would allow defense attorney Bruce Carmen to argue that Richardson should have been charged with reckless homicide.

“I’m not going to prohibit you from making that argument in an opening statement,” said the judge.

Henry County State’s Attorney Catherine Runty was also asked to give her opinion.

“I don’t think I would object to that in his opening statements,” she said.

Runty said after the hearing that the jury would be instructed on the lesser included charge of reckless homicide at the close of the trial.

Richardson has been held in the Henry County Jail with no bond since the incident.
